HC Verdict: Two Congress MLAs suspension cancelled

Hyderabad, Apr 18: The common division bench Hyderabad High Court has relieved the Congress leaders Komatireddy Venkat Reddy and Sampath Kumar, who were expelled from the assembly during the budget sessions.

The Telangana Assembly who expelled the leaders were given some respite by the Court which passed orders to restore memberships. The Court directed that the government can take disciplinary action against them if they are wrong but stated that the ban is unnecessary action adding that a case also can be filed against them if there is concrete evidence.

On the first day of the Telangana Budget Session, the members of the Congress raised concern at the House during the Governor's speech. During the same time, Komatireddy flung the headphone at the Chairman of the Legislative Council Swami Gowda who was rushed to the Sarojini Devi Eye hospital.

Following this, the Congress MLAs Komatireddy Venkat Reddy and Sampath Kumar were expelled for tarnishing the discipline of the House and their legislative memberships were canceled. Further, the Election Commission recommended holding elections for the Nalgonda and Alampur seats in the wake of the expulsion of MLAs.

Besides, all Congress MLAs, including Jana Reddy, were suspended from the Budget Session.

Komatireddy Venkat Reddy and Sampath Kumar approached the High Court on the issue of relegation. The court said it was unconstitutional to boycott the members from the assembly. The High Court, hearing repeated arguments over the issue, passed a resolution in favour of the Congress members.
