SC:Caste is determined by birth,doesnt change after Marriage

NewDelhi Jan 20: The Supreme Court on Thursday had commented that a Person caste is unchangeable and is determined by birth and doesn't change after marriage.The Apex court has also set aside the appointment of a woman teacher who joined Kendriya Vidyalaya 21 years ago taking benefit of reservation on the ground that she was married to a Scheduled Caste man.

The top court has also said that "the woman, who has now become vice-principal after serving two decades in the school, was not entitled to the benefits of reservation as she was born in an upper caste family and her caste remained so despite marrying into a Scheduled Caste family."

"There cannot be any dispute that the caste is determined by birth and the caste cannot be changed by marriage with a person of Scheduled Caste. Undoubtedly, she was born in 'Agarwal' family, which falls in general category and not in Scheduled Caste. Merely because her husband belongs to a Scheduled Caste category, she should not have been issued with a caste certificate showing her caste as Scheduled Caste" SC added

Earlier A woman has got an appointment as a teacher in school based on the SC Certificate issued to her as she has married an SC Man, however, a complaint was filed and the certificate was canceled and the woman has approached the apex court.
