Personal Beleifs also creep in Judgements by Judges

New Delhi Dec 12: Currently many people believe that Judges give the verdict based on the arguments heard and evidence presented and they keep aside their personal opinions while delivering judgments. However,
A recent survey had revealed some interesting facts about how the judges deliver verdicts and some loopholes in Indian criminal justice system.

Centre for Death Penalty, National Law University of Delhi has surveyed nearly 60 former Supreme Court judges including Justices Arijit Pasayat, Ashok Bhan, BN Srikrishna, Jeevan Reddy, MN Venkatachaliah, Swatanter Kumar, Ruma Pal and also late Justice AS Anand.

The report revealed that more than half of the judges believed the background of a judge influenced rulings in death row cases. 11 judges have awarded death sentence based on demands of 'collective conscience' i.e the society will only be satisfied if the capital punishment is awarded to the offender.

Judges have also supported the torture in Indian criminal justice system and said that "police resorted to torture because investigating agencies work under strenuous conditions without adequate time and independence to investigate cases."
