Good news for the HIV+ Children

New Delhi May 06: Here is the Good news for the HIV positive children's as the Supreme Court today asked the state governments to issue a notification to include children affected with HIV in the disadvantaged group for imparting free, compulsory education under the 2009 law.they made the statements here on Friday.

While coming to matter, A bench of Chief Justice J S Khehar and Justices D Y Chandrachud said that eleven states and one Union territory have issued a notification effecting a change in the Right of Children to Free and Compulsory Education Act, 2009 to also include HIV-positive kids in the "disadvantaged group".

The top court said the remaining states, which have not issued the notification so far in this regard, have also not approached it with any objection and hence, it is presumed that they are agreeable to the proposal.

"In view of the absence of such objections, we direct all remaining states (except Jammu and Kashmir) to issue the notification in eight weeks," the bench said while disposing of a PIL filed by NGO 'Naz Foundation' seeking special treatment for HIV-positive kids in schools across the country.
