High Court stay for land acquisition

Hyderabad, March 05: A land acquisition was going on at Adilabad Kalyan Khani for an open cast coal mining without consulting the gram sabha, so on Tuesday, Hyderabad High Court has given stay.

A division bench of Hyderabad HC comprising Acting Chief Justice Ramesh Ranganathan and Justice Shameem Akther has given stayed dispossession of farmers in the name of open cast coal mine, Mandamarri, scheduled area till the proposals of land acquisition are cleared by Gram Sabha.

The bench was dealing with PIL filed by Telangana Vidhyavanthula Vedika (TVV) complaining that without following the procedure contemplated under the act land acquisition proceedings are initiated.

The gram sabha has to give its consent to the proposed acquisition of the land in scheduled agency tribal area. When the case came up for hearing on Tuesday the respondents couldn't produce any papers to show that the law was followed. The bench granted stay till the gram sabha is convened and its consent was taken.
